CIUDAD DE MÉXICO (03/NOV/2012).- Un tribunal de México falló en favor de la firma mexicana de telecomunicaciones Ifone en una querella contra la estadounidense Apple por el uso de la marca Iphone, y ahora el gigante del cómputo deberá pagar una indemnización, informó la empresa local en un comunicado.

Un tribunal colegiado en materia administrativa “negó un amparo” (protección de la justica) a Apple en una querella que se remonta a 2009, cuando Ifone demandó a la estadounidense por la comercialización de su teléfono bajo el nombre “Iphone”, toda vez que causaba confusión entre los usuarios al pronunciarse ambas palabras de la misma forma, explicó la firma.

Según declaraciones del abogado de Ifone, Eduardo Gallart, que publica este sábado el diario Milenio, Apple deberá pagar una compensación a la compañía mexicana por el uso de la marca Iphone, pero el monto aún no ha sido establecido.

“La ley prevé un piso de 40% del precio de venta de los servicios que se hubieren comercializado en violación a la ley en nuestro país”, dijo Gallart, quien no aclaró si como parte del fallo Apple deberá también dejar de utilizar la marca Iphone.

“Es la tercera ocasión en que Apple pierde y eso demuestra la verdad jurídica evidente: Ifone está en pleno derecho del uso de su marca”, señala más adelante el comunicado, que además reconoce a la justicia mexicana por proteger a una pequeña empresa ante un “gigante”.

La compañía mexicana asegura que opera desde 2003 con el nombre de Ifone, como una fusión de las palabras “Internet” y “Teléfono” para comercializar sistemas y servicios de comunicación. Apple introdujo el Iphone en el mercado mexicano en 2007.

Ifone explicó que inició en 2009 la querella en el Instituto Mexicano de la Propiedad Intelectual, ante el cual tenía registrada su marca.

No fue posible obtener una respuesta de parte de Apple México, que en su sitio de internet ya inició la venta de la quinta versión de su llamado “teléfono inteligente”.

Ya sé que aprenderse todos esos numerajos es un rollo patatero, pero en realidad con el 164 de la eñe minúscula basta, ya que el resto no se usan ni tres veces al año. Y para esas veces no les cuesta nada volver a visitar esta página!
* Nota para portátiles: Para activar el teclado numérico (que en los portátiles está escondido entre las teclas de la derecha del teclado) hay que presionar la tecla Fn. Así, para conseguir la Ñ combinaremos Fn + Alt + 165, y con las demás igual. Esto no siempre es efectivo, porque dependiendo del programa que estemos usando pudiera ser que llamemos a otra función distinta. En ese caso:
* Alternativamente podemos cambiar la configuración del teclado, para ello tenemos que abrir la configuración de idioma pinchando en “Start => Contol panel => Regional and Language settings” y seleccionar España o el país que queramos. Después, es cada ventana en la que vayamos a escribir hay que pinchar abajo a la derecha, donde dice “EN”, y seleccionar “español”. Ahora el teclado será español, por lo que hay que andarse con ojo porque las teclas no corresponderán con lo que dicen, pero podremos lograr la Ñ con la tecla del punto y coma, al lado de la L.

– ¿: No hay método rápido. Hay que abrir el “Character Palette” pinchando en la banderita de país de arriba a la derecha y luego “Show Character Palette”.

En el panel superior, vayan a
System > Preferences > Keyboard > Layouts > Layout Options > Composite Key Position.
Ahí elijan la tecla “compuesta”, por ejemplo Alt Gr. Luego simplemente escriban combinaciones de tres teclas

Using Windows.Forms gets really ugly when you need to access the user interface from multiple threads. IMHO, this is an example of leaky abstraction.

When you run a program with this UI threading issue from within Visual Studio, it will always throw an exception. The same program running as a standalone EXE may not throw the exception. That is to say, the development environment is stricter than the .NET framework.

I know my business needs a Strategic Plan, but who has the time to do it?

As with anything worthwhile, a good strategic plan does take time. But most of what goes into a strategic plan are things you already know. The main thing is to get the process started.

Because you’re busy, you need a strategic plan format that is efficient, flexible and interactive. Strategic planning is an ongoing process, so the format must allow for information to be captured, shared, and updated in real time.

The One-Hour Strategic Plan

To get a very basic strategic plan developed within a sixty-minute timeframe, you need to be prepared to maximize the time allotted. For the best results, take the following steps in advance:

  1. Make sure that the key people who guide your company’s direction are present. If your organization comprises only you or a couple of business partners, you might want to invite one or more people whose business acumen you respect to join.
  2. Outline your meeting and share your agenda with all participants in advance. Let them know you’ll be seeking their input and ask them to be ready to contribute.
  3. Use a conference room with a projector so you can build your strategic planning document in real time. If attendees are remote, use an online meeting platform such as WebEx® or GoToMeeting®.
  4. Watch your time and stick with your agenda. Avoid getting into too much detail – limit this meeting to big-picture thinking. Details can be added later.

To have an effective strategic plan, it’s important to be brutally honest about your company and its competitive environment. Only through a realistic assessment of these areas can you develop a valid plan for your organization’s future.

In performing this analysis, you may indentify areas of weakness that need to be either improved or eliminated. Perhaps your company has unique strengths that are not being fully utilized. Shifting conditions in the economy or your specific industry may be revealing opportunities you should pursue or threats that need to be hit head on or avoided entirely.

As we work through our SWOT analysis we continue building our mind map in real time and now have a visual that looks like this.

Final Step: Formulate a Strategy

We now have the basic framework needed to move into the final phase of the strategy plan. For Acme Printing, this will involve outlining an operating plan. Because the operating plan includes a number of items, we linked it to a new visual, shown below.

The court said that Apple had infringed a patent held by Samsung relating to the way phones and tablet PCs connect to the internet.

Apple, which recently became the world’s most valuable firm, has been facing various legal issues.

In a separate case, it was fined $2.3m (£1.5m) in Australia for its claims on 4G capabilities of the iPad.

And it is still not clear how much it may have to pay to Samsung in damages.

The Dutch court did not specify any amount, but the damages will be calculated based on sales of Apple’s iPhone and iPad in the Netherlands.

“Samsung welcomes the court’s ruling, which reaffirmed Apple’s free-riding of our technological innovation,” the South Korean manufacturer said in an emailed statement to the BBC.

“In accordance with the ruling, we will seek adequate compensation for the damages Apple and its products have caused.”

Samsung had claimed that Apple had infringed four of its patents. However, the Dutch court said that only one of those had been breached.

Artificial blood vessels made on a 3D printer

Artificial blood vessels made on a 3D printer may soon be used for transplants of lab-created organs.
Until now, the stumbling block in tissue engineering has been supplying artificial tissue with nutrients that have to arrive via capillary vessels.
A team at the Fraunhofer Institute in Germany has solved that problem using 3D printing and a technique called multiphoton polymerisation.
The findings will be shown at the Biotechnica Fair in Germany in October.
Out of thousands of patients in desperate need of an organ transplant there are inevitably some who do not get it in time.
In Germany, for instance, more than 11,000 people have been put on an organ transplant waiting list in 2011 alone.
To make sure more patients receive these life-saving surgeries, researchers in tissue engineering all over the globe have been working on creating artificial tissue and even entire organs in the lab.
But for a lab-made organ to function, it needs to be equipped with artificial blood vessels – tiny and extremely complex tubes that our organs naturally possess, used to carry nutrients.

Numerous attempts have been made to create synthetic capillaries, and the latest one by the German team seems to be especially promising.
“The individual techniques are already functioning and they are presently working in the test phase; the prototype for the combined system is being built,” said Dr Gunter Tovar, who heads the BioRap project at Fraunhofer Institute for Interfacial Engineering and Biotechnology IGB in Stuttgart.

Elastic biomaterials

3D printing technology has been increasingly used in numerous industries, ranging from creating clothes, architectural models and even chocolate treats.
But this time, Dr Tovar’s team had a much more challenging printing mission.
To print something as small and complex as a blood vessel, the scientists combined the 3D printing technology with two-photon polymerisation – shining intense laser beams onto the material to stimulate the molecules in a very small focus point.
The material then becomes an elastic solid, allowing the researchers to create highly precise and elastic structures that would be able to interact with a human body’s natural tissue.
So that the synthetic tubes do not get rejected by the living organism, their walls are coated with modified biomoelcules.
Such biomolecules are also present in the composition of the “inks” used for the blood vessel printer, combined with synthetic polymers.
“We are establishing a basis for applying rapid prototyping to elastic and organic biomaterials,” said Dr Tovar.
“The vascular systems illustrate very dramatically what opportunities this technology has to offer, but that’s definitely not the only thing possible.”

La mayor compañía de software del mundo dice que millones de personas ya están utilizando una versión preliminar que descargaron de Windows 8 en sus Pcs, laptos y dispositivos táctiles antes de su introducción oficial este otoño boreal.

En un evento mediático en Los Angeles el lunes, la compañía tiene previsto discutir sus planes de superar al iPad de Apple Inc esta temporada de compras de fin de año.

Hasta el momento, la mayor parte de los críticos han elogiado el aspecto de estilo amigable táctil “Metro” de Windows 8, que está basado en coloridos cuadrados, o mosaicos, que representan aplicaciones como correo electrónico y actualizaciones en tiempo real. Pero también han resaltado lo difícil que será para los usuarios alejarse de lo que ya conocen y confían.

Es como una cierta lucha para la gente que está deliberadamente orientada a una PC, que está acostumbrada al mouse”, dijo el ex estratega de Microsoft Al Hilwa.

Hilwa, ahora un analista en la empresa de investigación tecnológica IDC, ha estado probando durante dos semanas la última muestra de la versión. “Sin la pantalla táctil, luchaba con un mouse para hacer ciertas cosas”, dijo.

La nueva interfaz Metro solo ejecuta programas diseñados para ella, por lo que los usuarios deben volver a sus tradicionales computadoras de escritorio para realizar ciertas tareas, tales como escuchar música en iTunes de Apple.

“Lo que realmente me enfurece es que las aplicaciones Metro y las aplicaciones que se ejecutan en las computadoras de escritorio no están al tanto de la existencia de la otra”, dijo el analista de Forrester Research David Johnson. “No existe una forma fácil de navegar entre ellas, no estoy muy seguro a qué se debe”.

La última versión de la prueba del software aún no está concluida. Y aparte de unos pocos examinadores de la industria, nadie ha probado a Windows 8 en una tableta impulsada por los ultra eficientes chips de ARM Holdings, que es lo más cerca que Microsoft se aproximará para desafiar al iPad.

Microsoft debe ofrecer más detalles el lunes, y existen rumores de que podría introducir una tableta con su propia marca. La compañía se negó a hacer comentarios respecto a la reacción al nuevo sistema y sobre sus planes para el evento del lunes.

El puñado de comentarios en los blogs centrados en tecnología en general elogiaron el nuevo aspecto de Windows 8, pero prácticamente cada uno ha resaltado lo difícil que será para los usuarios hacer el cambio.

“No podría dar a mi madre -que tiene 76 años- Windows 8 y esperar que sea productiva con el sistema”, dijo Johnson de Forrester. “Pero tampoco estoy seguro de que alguien de 30, o incluso 20 años, no se confundirá inicialmente con la interfaz de Metro”.

Los consumidores individuales y potenciales compradores del iPad, más que clientes corporativos, son el objetivo principal de Windows 8. Muchas grandes compañías se encuentran aún en el proceso de gastar millones de dólares para cambiarse a Windows 7.
